Terms of service

These Terms of Use (hereinafter referred to as “ToU”) define the terms and conditions for using the memoirƨ platform, accessible at http://app.getmemoirs.com.

The content and services offered on https://getmemoirs.com/ are provided by THE ARTIST ACADEMY, a simplified joint-stock company (SAS) with capital of €56,284, headquartered at 3 bis rue Jadin, 75017 Paris, France, and registered with the Paris Trade and Companies Register under number 838 153 443.

Using the Site does not require account creation, except when accessing paid services. In all cases, Users agree to comply with these ToU for all products, services, and content on the Site—whether free, purchased individually, or as part of a bundle.

The ToU are binding upon the User, who acknowledges having read and accepted them fully and without reservation before placing any order, accessing content, or using the Site in any way, by checking the corresponding box.

THE ARTIST ACADEMY is constantly working to improve its services and regularly develops new features to enhance the user experience. As such, these ToU may be updated.

THE ARTIST ACADEMY will inform Users of any changes to the ToU by any means, such as email or in-platform notifications. Once the revised ToU come into effect, continued use of the services will constitute acceptance of the new terms.

THE ARTIST ACADEMY also reserves the right to modify, suspend, or remove any service from the Site at any time and without prior justification.

Definitions

Administrator(s): Any person responsible for managing the Site and ensuring that Users comply with the ToU.
Content: Includes, but is not limited to, the structure of services, editorial content, videos, texts, images, sounds, illustrations, photos, sections, FAQs, links, games, and any other content on the Site or published on THE ARTIST ACADEMY’s social networks.
Social Networks: Refers to platforms such as Facebook, Twitter, YouTube, and Instagram where THE ARTIST ACADEMY publishes content and interacts with its community.
Services: The services published by THE ARTIST ACADEMY and accessible via the Site or its social media platforms.
Site: The website https://getmemoirs.com/
User(s): Any individual who accesses or uses the Site and its services.

User Obligations

The memoirƨ services, as well as all content accessible through the service, are intended solely for personal and non-commercial use.

The User agrees not to use another User’s account or share their own login credentials (email address and password) with anyone. The User is fully responsible for all activities carried out under their password or account, and must ensure that their password remains confidential and secure. The User agrees to immediately notify THE ARTIST ACADEMY of any unauthorized use of their password or account, or any other security breach, and to log out at the end of each session.

THE ARTIST ACADEMY shall not be held liable for any loss or damage resulting from the User’s failure to comply with these obligations.

The User agrees not to modify, reproduce, or hack the Site and/or not to create another website that could mislead potential clients into believing it is associated with THE ARTIST ACADEMY.

The User also agrees not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Site, its use, or access to its Content.

Use of the Site and Services

As part of their use of the memoirƨ platform, the User may generate, edit, and store personal content (texts, photos, voice recordings, etc.) using the tools provided, including AI-assisted features.

This content is strictly personal and private, and is not published or shared by THE ARTIST ACADEMY unless explicitly requested by the User.

The User is solely responsible for the content they generate, modify, or validate. The User warrants that this content does not infringe upon third-party rights (copyright, image rights, privacy, etc.) and complies with applicable laws and regulations. THE ARTIST ACADEMY accepts no responsibility for the legality of the content generated by the User.

Use of Artificial Intelligence

The Service offers writing assistance based on artificial intelligence technologies. The User is solely responsible for any content generated using these tools. It is the User's responsibility to proofread, verify, correct, and validate any AI-generated text before publishing or exporting it.

THE ARTIST ACADEMY does not guarantee the accuracy, relevance, compliance, or legality of AI-generated content and disclaims all liability for any errors, inappropriate statements, or harmful outputs produced via AI.

Final Content Generation and Usage Limitations

Once the final document (e.g., PDF or audio version) is generated and validated by the User, no further generation is allowed unless the User subscribes to an additional service.

The User is strongly encouraged to review the completeness and accuracy of their content before confirming the final version.

Retention of Personal Data and Content

In accordance with applicable personal data protection laws, you have the right to access, rectify, delete, object to, limit, and port your data.

Content generated by the User, including texts, photos, and voice recordings, is retained for a maximum of one (1) year from the date of final project validation. This is for purposes of security, historical tracking, or customer support. After this period, the data will be deleted, unless there is a legal obligation or the User has explicitly consented to extended retention.

Audio Services

The Service optionally offers, for an additional fee, to generate an audio version of the User’s memoir using a personalized synthetic voice based on a voice recording provided by the User.

Once the User has approved the voice sample, no further changes can be made to the generated voice. Only one final audio rendering is included in the service. Any additional request will be subject to a new charge.

The User certifies that they own the rights to the recorded voice and agrees not to impersonate or reproduce the voice of any third party.

Important Reminder

The User is solely responsible for the content they publish or generate through the Service, including content generated using AI.

THE ARTIST ACADEMY acts solely as a technical host and exercises no control over the accuracy, legality, or relevance of the content.

No external publication, distribution, or editing is carried out without the express action or validation of the User.

In Case of Abuse

In accordance with French Law No. 2004-575 of June 21, 2004, on Confidence in the Digital Economy, Users may report any illegal content under the terms of Article 6-I of the law.

Site Accessibility and Maintenance

THE ARTIST ACADEMY implements the necessary measures to ensure the availability of the Site and its Services, except in cases of force majeure or events beyond its control, and subject to technical issues and maintenance work essential for the proper functioning of the Site. Maintenance may occur without prior notice to Users.

THE ARTIST ACADEMY does not guarantee the uninterrupted availability, accessibility, or absolute security of the Services.

THE ARTIST ACADEMY’s Liability and Force Majeure

The User expressly acknowledges that they use the Site and its Services at their own sole risk.

THE ARTIST ACADEMY cannot be held liable for any direct or indirect damages of any kind resulting from the unavailability or failure of the Site or its Services, data loss, or presence of viruses on the Site, except where such damage results from a breach of its obligations. Users are responsible for keeping backups of all content they publish on the Site or THE ARTIST ACADEMY’s social media.

THE ARTIST ACADEMY shall not be held responsible for any total or partial non-performance resulting from a force majeure event, including but not limited to war, internal or external strikes, riots, storms, earthquakes, floods, fires, technical failures, or any other unforeseeable and unavoidable events recognized by French or European case law.

Intellectual Property of THE ARTIST ACADEMY

All documents, texts, audiovisual sequences, graphics, images, illustrations, comments, photographs, or any other content published on the Site or on THE ARTIST ACADEMY’s social media are the exclusive property of THE ARTIST ACADEMY and are reserved for its use.

This also includes titles, trademarks, screenshots, names, and logos belonging to THE ARTIST ACADEMY.

These elements may not be altered, reproduced, exploited, or used in any way without prior written authorization from THE ARTIST ACADEMY. Tampering with or cropping logos is also prohibited.

Any reproduction, distribution, or modification without prior written permission exposes the violator to legal action.

The User agrees not to sell, license, sublicense, assign, pledge, or otherwise transfer any of the aforementioned elements.

Hyperlinks

The Site may contain links to third-party websites over which THE ARTIST ACADEMY has no control. Despite regular checks, THE ARTIST ACADEMY disclaims all responsibility for the content found on such external websites.

Users are solely responsible for the use of content found on linked third-party sites.

THE ARTIST ACADEMY allows hyperlinks to its Site provided that the following conditions are met:

The source is clearly stated with a link directly pointing to the targeted content.
The content is used only for personal, educational, associative, or professional purposes. Any commercial or advertising use is prohibited.

Personal Data

To ensure the security of content, THE ARTIST ACADEMY collects usage information (e.g., login times, number of devices used).

Duration

These ToU bind THE ARTIST ACADEMY and the User from the moment the User accepts them. If the User refuses the terms, they agree to stop using the Site and its Services.

This agreement remains in effect for as long as the Site and Services are used.

Failure to comply with these ToU may result in the immediate termination of the contract and suspension of access to Services, without prior notice and without prejudice to potential damages owed to THE ARTIST ACADEMY.

Miscellaneous Provisions

If any provision of these ToU is found to be invalid or unenforceable by law or court decision, it shall be deemed unwritten, and the remaining provisions shall remain in full force.

Governing Law

These ToU are governed by French law.

In case of disputes relating to the interpretation, performance, or termination of this contract, the User and THE ARTIST ACADEMY shall first attempt to reach an amicable settlement before pursuing legal action.

If no agreement is reached, French courts shall have jurisdiction.
